938. ARTICLE 138. COMPLAINTS OF WRONGS

11. Miscellaneous Provisions

Any member of the armed forces who believes himself wronged by his commanding officer, and who, upon due application to that commanding officer, is refused redress, may complain to any superior commissioned officer, who shall foreword the complaint to the office exercising court- martial jurisdiction over the officer against whom it is made. The officer exercising general court-martial jurisdiction shall examine into the complaint and take proper measures for redressing the wrong complained of; and he shall, as soon as possible, send to the Secretary concerned a true statement of that complaint, with the proceedings thereon.

    Is this exactly how it is worded in the actual UCMJ?
    The first sentence contains the phrase “who shall foreword the complaint” which is not grammatically correct. The word “forward” rather than “foreword” should have been used.

      The UCMJ was set aside because the demotion was erroneous. The charges were clearly made up. One charge was dereliction of duty for not replacing me at staff duty. The officer who charged me fail to check with the NCOIC who does the schedule, (I WERE NEVER SCHEDULE TO DO STAFF DUTY). How can I be derelict in my duties if I’m not on the schedule? This is a leader of Soldiers? By these leaders lying and mistreating Soldiers they are causing stress, anger, depression, hatred, and fear (Soldier becomes scared because they are a target. Some seniors do not always do the right thing they abuse their authority some even do and say anything about Soldiers simply because of dislike or they pass judgment because of medical permanent profile and other issues. It is abuse and against UCMJ. Mistreatment encompasses a range of behaviors, including emotional; this is the reason of the high suicides in the Army bad leadership, in some places they have teamed up and their goal is to punish Soldiers, This is happening. Just because a senior leader appears to be doing his job at the top (in front of other high command) some of the things that are being done to the soldier is server. If you want to stop suicide speak to Soldiers about their leaders and command. ONE JUDGMENT DAY THEY WILL HAVE TO ANSWER FOR THEIR WRONG DOING. The Soldier will have justice if not in this life they will in the after life.

    The lt at my office in the Air Force has been wrongfully accusing me of things she has concocted in her mind?She singles me out and has told people to report to her with any dirty information.She encourages her subordinates to drink alcohol, set me up for reprisals when I tried to Palace Chase.She’s investigating me unjustly said she came back in the military after getting out from enlisted as an officer for revenge.She comes to work drunk and sometimes seems incoherent and crazy.However, she got all these medals and crap so she’s got a foot up on some ppl.She’s obviously talking behind my back and it’s people like her why I no longer want to stay in the Air Force.With crazy ppl like this in the military no wonder suicides are at a high in the Air Force and some clown ass program or team building is not going to make it better.If bitches and assholes who are good at putting the blinds over ppls eyes are allowed to stay in these prestigious positions playing god.There needs to be some actions set up so they will be held accountable for her actions.She got drunk at a unit function and then made fun of one of her subordinates wife’s who was breastfeeding her baby.Admitted that she slept with the husbands,boyfriends etc of all the black females who treated her horribly.

    wich means NOBODY, so dummy down, button your lip, and get with the program.

      Wow, I read your comment and I can’t say I’m not shocked of the ignorance displayed by this statement. Your verbiage is garbage, you should have more respect. I sure hope you are not a leader of soldiers in the US military. if you are I feel so sorry for those troops.

    former navy recently received copy of my service record, noticed there is an entry in the file stating that I was not performing to navy standards not in the exact wording but this was the line they were taking. I & we does not exist.as I recall it’s (team work) not individual!…ps was something like could not perform task in minimum amount of time doing simple task’s. need constant supervision?…does anyone re: Piss poor Leader ship results in Piss Poor Performance????? THANKS N.C.

    If I belong to a minority group and the command puts someone in charge of us who has no connection and then has strict or regulations placed on us. Is that a violation? There is other minority groups but they have had regulation relaxed.
