<p>(a) The following persons on active duty or performing inactive-duty training may administer oaths for the purpose of military administration, including military justice, and have the general powers of a notary public and of a consul of the United States, in the performance of all notarial acts to be executed by members of any of the armed forces, wherever they may be, by persons serving with, employed by, or accompanying the armed forces outside the United States and outside the Canal Zone, Puerto Rico, Guam, and the Virgin Islands, and by other persons subject to this chapter outside the United States.</p>
<blockquote><p>(1) All judge advocates</p>
<p>(2) All summary courts-martial.</p>
<p>(3) All adjutants, assistant adjutants, acting adjutants, and personnel adjutants.</p>
<p>(4) All commanding officers of the Navy, Marine Corps, and Coast Guard.</p>
<p>(5) All staff judge advocates and legal officers, and acting or assistant staff judge advocates and legal officers.</p>
<p>(6) All other persons designated by regulations of the armed forces or by statute.,</p></blockquote>
<p>(b) The following persons on active duty or performing inactive-duty training may administer oaths necessary in the performance of their duties:</p>
<blockquote><p>(1) The president, military judge, trial counsel, and assistant trial counsel for all general and special courts-martial.</p>
<p>(2) The president and counsel for the court of any court of inquiry.</p>
<p>(3) All officers designated to take a deposition.</p>
<p>(4) All persons detailed to conduct an investigation.</p>
<p>(5) All recruiting officers.</p>
<p>(6) All other persons designated by regulations of the armed forces or by statute.</p></blockquote>
<p>(c) No fee may be paid to or received by any person for the performance of any notarial act herein authorized.</p>
<p>(d) The signature without seal of any such person acting as notary, together with the title of his office, is prima facie evidence of his authority.</p>

<p>(a) An act, done with specific intent to commit an offense under this chapter, amounting to more than mere preparation and tending, even though failing, to effect its commission, is an attempt to commit that offense.</p>
<p>(b) Any person subject to this chapter who attempts to commit any offense punishable by this chapter shall be punished as a court-martial may direct, unless otherwise specifically prescribed.</p>
<p>(c) Any person subject to this chapter may be convicted of an attempt to commit an offense although it appears on the trial that the offense was consummated.</p>

<p>(a) Any person subject to this chapter who solicits or advises another or others to desert in violation of section 885 of this title (article 85) or mutiny in violation of section 894 of this title (article 94) shall, if the offense solicited or advised is attempted or committed, be punished with the punishment provided for the commission of the offense, but, if the offense solicited or advised is not committed or attempted, he shall be punished as a court-martial may direct.</p>
<p>(b) Any person subject to this chapter who solicits or advises another or others to commit an act or misbehavior before the enemy in violation of section 899 of this title (article 99) or sedition in violation of section 894 of this title (article 94) shall, if the offense solicited or advised is committed, be punished with the punishment provided for the commission of the offense, but, if the offense solicited or advised is not committed, he shall be punished as a court-martial may direct.</p>

<p>(a) Any member of the armed forces who&#8211;</p>
<blockquote><p>(1) without authority goes or remains absent from his unit, organization, or place of duty with intent to remain away therefrom permanently;</p>
<p>(2) quits his unit, organization, or place of duty with intent to avoid hazardous duty or to shirk important service; or</p>
<p>(3) without being regularly separated from one of the armed forces enlists or accepts an appointment in the same or another on of the armed forces without fully disclosing the fact that he has not been regularly separated, or enters any foreign armed service except when authorized by the United States; is guilty of desertion.</p></blockquote>
<p>(b) Any commissioned officer of the armed forces who, after tender of his resignation and before notice of its acceptance, quits his post or proper duties without leave and with intent to remain away therefrom permanently is guilty of desertion.</p>
<p>(c) Any person found guilty of desertion or attempt to desert shall be punished, if the offense is committed in time of war, by death or such other punishment as a court-martial may direct, but if the desertion or attempt to desert occurs at any other time, by such punishment, other than death, as a court-martial may direct.</p>
